SCF Australia Pty Ltd Terms & Conditions

1. Definitions:
- “SCF Activities” include (but are not limited to) all forms of fishing, including rod fishing, shore fishing, boat fishing, spear fishing, and free diving. I understand I will not be under the direct supervision of SCF during these activities.
- “Claim” refers to any action, suit, proceeding, claim, demand, damage, penalty, cost, or expense arising from personal injury, property damage, or economic loss.
- “SCF” refers to SCF Australia Pty Ltd and its affiliated businesses.
- "Deluxe" Members receive coast guard coverage for the duration of competitive events and 5x bonus entries into the King of Kings Lucky Draws.

2. Governing Law:
- This Waiver and Declaration will be interpreted under and governed by the laws of Queensland.
- My application is deemed accepted upon participation in SCF Activities.
- I agree to comply with SCF’s constitutions, by-laws, regulations, and policies, which may change over time.

3. Warning:
- I understand that SCF Activities involve dangerous sports and carry a risk of injury or loss, including death.
- I acknowledge that I am aware of these risks and voluntarily choose to participate, fully appreciating their nature and extent.

4. Fitness to Participate:
- I declare that I am medically and physically fit to participate in SCF Activities and that I pose no danger to myself or others.
- I will notify SCF in writing of any changes to my medical condition, fitness, or ability to participate.

5. Exclusion of Implied Terms:
- As a consumer of recreational services, I acknowledge that certain rights or terms usually implied into contracts for goods and services may not apply.

6. Release & Indemnity:
- In consideration of SCF accepting my application:
- (a) I forever release SCF from all Claims arising from my participation in SCF Activities.
- (b) I indemnify and will keep indemnified SCF to the extent permitted by law against any Claim made by any person in connection with my participation in SCF Activities.

7. Confidentiality:
- I understand that through my participation, I may have access to confidential proprietary information and contacts critical to SCF.
- I agree not to teach, share, or profit from any proprietary information obtained through SCF.

8. Severability:
- If any provision of this agreement is deemed prohibited, invalid, or unenforceable in any jurisdiction, that provision will be ineffective to the extent of its prohibition or invalidity without invalidating the remaining provisions.

9. Declaration:
Upon purchasing an SCF Membership the customer agrees to have read, understood, and agree to the above declaration, including the warning, exclusion of liability, release & indemnity, fitness to participate, confidentiality, and privacy provisions.

By purchasing a membership you acknowledge the terms and conditions of SCF membership.
